Event Overview:  
Dental practices faced many challenges in 2022, from continuing to navigate the effects of the COVID-19 pandemic, to dealing with the complexities of insurance billing, and keeping patients happy. One area that may sometimes be overlooked is that while dental practices are medical providers, they are also employers. Employment law continues to evolve at a rapid pace and presents many complex, new issues for you to navigate as employers. At the same time, dental practices continue to face tricky employment law problems that have been around for many years. During this interactive program, Ari Kristan and Rich Loftus of Hirsch Roberts Weinstein LLP will talk about how to spot and avoid some of the most common legal pitfalls, both old and new, encountered by dental industry employers.

Learning Objectives:  

  • Learn about the strict rules around timely payment of wages in Massachusetts, and how to avoid potentially large penalties for even unintentional violations. 
  • Best practices for employee handbooks, including "must have" and "should have" policies for your practice. 
  • How to reduce the risk of errors in the interactive dialogue regarding employee requests for reasonable accommodation of a disability.
  • Using restrictive covenants in dental practices.
  • The importance of documentation of employee performance and discipline in avoiding legal liability. 
  • Identifying and avoiding common pitfalls concerning the Massachusetts Paid and Family Leave Law.

Speaker Bios:


Arielle B. Kristan (“Ari”) advises businesses, non-profits, and colleges and universities in avoiding employee conflict and minimizing the risk of costly litigation.  She assists clients in complying with federal and state employment laws, including anti-discrimination and anti-retaliation laws, wage and hour laws, and laws related to employee family and medical leaves.  Ari also works as an investigator of claims of workplace misconduct and discrimination. An experienced litigator, Ari represents clients in state and federal court and before administrative agencies, including the EEOC and the MCAD.  Ari understands the importance of minimizing the disruption and cost of litigation for her clients and works to obtain successful results for clients as early in the litigation process as possible through the use of motions for preliminary relief, motions to dismiss, and summary judgment.

Richard S. Loftus (“Rich”) is an experienced litigator who has successfully represented businesses and employers in state, federal, and administrative proceedings and defended those victories on appeal. Rich focuses his practice on defending employers from single plaintiff and class action wage and hour matters, employment discrimination cases, and in litigating noncompetition and commercial disputes between businesses. Rich also serves as a trusted advisor to clients from a wide range of industries on subjects such as wage and hour compliance, COVID-19 pandemic issues, anti-discrimination laws at both the federal and state level, employment contracts, restrictive covenants, and noncompetition agreements, FMLA and the Massachusetts PFML, and other employment-related issues.  Rich is particularly passionate about helping his clients avoid the significant penalties that accompany failure to comply with wage and hour laws and is a frequent author and presenter on that subject.
